The Chakwera administration has prioritized the Rule of Law as a foundational element of its governance, aligning with the "Hi-5" agenda that emphasizes democratic values and institutional integrity. Since 2020, efforts have been directed toward strengthening judicial independence, enhancing transparency, and ensuring accountability across government institutions.
Notably, in December 2024, Malawi's National Assembly passed three bills aimed at establishing a comprehensive regulatory framework for the judiciary, intended to bolster its independence and accountability. Additionally, the administration has enacted 25 out of 29 proposed bills through the Ministry of Justice, reflecting a commitment to legal reforms.
Problems to be solved
Perceptions of selective justice and inconsistent application of anti-corruption measures, leading to public skepticism.
Incidents raising concerns about press freedom and freedom of expression, such as the arrest of journalists and individuals for content critical of the government.
Delays in implementing comprehensive judicial reforms, including the full enactment of judicial reform bills.
Opportunities to unlock
Finalizing and implementing the remaining judicial reform bills to strengthen the legal framework and judicial independence.
Establishing clear guidelines and protections to uphold press freedom and freedom of expression, ensuring that legal actions do not infringe on constitutional rights.
Continuing to support and resource law enforcement and judicial institutions to effectively uphold the rule of law and maintain public trust.
